In 2006, Bollea was videotaped while having sex with Heather Clem at trial he claimed that the videotaping was without his knowledge or consent. On November 2, 2016, Gawker reached a $31 million settlement with Bollea. Gawker Media's assets, not including the namesake website, were subsequently sold to Univision Communications. Three months after the verdict, Gawker filed for Chapter 11 bankruptcy protection and put itself up for sale. In March 2016, the jury found Gawker Media liable and awarded Bollea $115 million in compensatory damages and $25 million in punitive damages. Prior to trial, Bollea's lawyers said the privacy of many Americans was at stake while Gawker's lawyers said that the case could hurt freedom of the press in the United States. Bollea's claims included invasion of privacy, infringement of personality rights, and intentional infliction of emotional distress. In the suit, Terry Eugene Bollea, known professionally as Hulk Hogan, sued Gawker Media, publisher of the Gawker website, and several Gawker employees and Gawker-affiliated entities, for posting portions of a sex tape of Bollea with Heather Clem, at that time the wife of radio personality Bubba the Love Sponge. Ayyadurai sued, claiming that his reputation and career suffered as a result of the articles, and he didn’t appreciate Sorkin’s characterization of his claim. The Gawker-owned site Gizmodo, and Gawker itself, published articles indicating that Ayyadurai is a fraud. One of Harder’s cases that Sorkin called “puzzling” was the one brought by Shiva Ayyadurai. Ayyadurai claims that he invented email, and has made a living on that reputation. Sorkin wondered if having the same lawyer meant that the cases were all being bankrolled by the same person. The piece, written by Andrew Ross Sorkin, mentions that multiple lawsuits against Gawker, including the notorious case brought by Hulk Hogan that resulted in a $140 million verdict for the wrestler, were being handled by the same attorney, Charles Harder.

The New York Times published an article on Monday that raised questions about whether lawsuits against Gawker have been funded by a third party looking to hurt the gossip website.
